General terms and conditions

Alloboissons SA, whose head office is located Route du Tir Fédéral, 1762 Givisiez (hereinafter "Alloboissons"), is specialized in the fine distribution of all beverages. Alloboissons operates an e-commerce and provides a delivery service.

The proposed offer is addressed to private persons of legal age and legal entities domiciled in Switzerland as well as to companies, events, EPAL and HORECA customers registered in Switzerland. The delivery area is limited to the territories of Switzerland.

These General Terms and Conditions (hereinafter referred to as "GTC") govern the entire purchasing process in the online supermarket, in particular the registration of customers, the storage and use of customer data, orders, deliveries, payments, customer service and complaints.

The use of customer data is governed by the data protection declaration. Reference is expressly made to this declaration, which is an integral part of these GTC.

2.2        Beverages

Alloboissons strives to accurately communicate product information. The product descriptions published in the online shop are updated regularly and with the utmost care. In exceptional cases, these descriptions may not match information on product packaging. In this case, the information on the packaging prevails.

With regard to wines, Alloboissons guarantees the accuracy of the information relating to the producer and the vintage published on the site.

The sale of beer, wine and cider to young people under the age of 16 is prohibited. The sale of distilled beverages to minors under the age of 18 is prohibited. By accessing our offers, you declare that you are 18 years old.

2.3        Rental equipment

The rental equipment requires prior reservation from the Manifestations Service, by email to servicemanifestations@alloboissons.ch.

3.1        VAT

Prices are exclusive of VAT:

  • Non-alcoholic beverages: 2.6 %
  • Alcoholic beverages: 8.1 %
  • Rentals, equipment, glasses, towels, miscellaneous: 8.1 %

3.2        Recycling fees and non-returnable packaging

  • Aluminium cans, PET bottles and used glass bottles: CHF 0.03
  • Provision and return of bags for PET bottles: service offered
  • Provision and return of bags for aluminium cans: service offered
  • Exchange by blue barrel for the return of used glasses: CHF 10.00
  • Vini-Harasse (crate), top & litre of wine, on loan, to return to us: no deposit

3.3        Packaging deposits

  • Glass bottles 18cl / 20cl / 30cl / 35cl / 50cl: CHF 0.30
  • Glass bottles 75cl / 100cl / 150cl: CHF 0.50
  • Crates: CHF 5.00
  • Barrels /Containers /Blue barrels for return of used glasses: CHF 50.00
  • Gas cylinders: CHF 100.00
  • Coolkegs: CHF 150.00

4.1       Payment methods

We accept the following payment methods:

  • Postfinance Card
  • PostFinance e-finance
  • Visa
  • Mastercard
  • By invoice
  • Cash on delivery

4.2        Payment terms

Payment can be made at the time of the order, cash on delivery or, according to agreement, 15 working days from the date of the invoice.

Alloboissons reserves the right to deduct costs incurred after the 2nd reminder and to charge a default interest rate of 1% per month in the case of late payment.

Alloboissons also reserves the right to make deliveries only against cash payment. The goods and their packaging remain the property of the Alloboissons Group until they have been paid for in full.

4.3        Invoices

Prices are exclusive of VAT.

VAT is displayed separately in the second section of the invoice.

5.1        Order terms

Once the online ordering procedure has been finalised by clicking on the "place order" button, the order is completed and can no longer be modified online. In addition, by clicking on this button, the customer confirms the accuracy of all the information provided and submits a binding purchase order to Alloboissons for the products ordered. Shortly after finalising the order, an email from Alloboissons provides a provisional automatic order confirmation, which constitutes acceptance of the purchase order by Alloboissons. Following your online order, the member service approves the order. If for reasons of unavailability or delivery time the order cannot be approved, Customer Service will contact you.

Only the confirmation verifies the establishment of a contractual link between the customer and Alloboissons.

It is important to receive a confirmation by email. If this is not the case, a computer problem has occurred. Please place your order again by logging on to DIVO.ch.

Orders for the agreed delivery day must reach Alloboissons no later than the previous working day (Monday to Friday) before 10:00 am.

For orders placed by private individuals in the canton of Geneva, delivery time is up to 48 working hours.

Delivery terms may be changed on public holidays.

Products requiring additional time for delivery are indicated. Specially ordered products cannot be returned.

5.2        Telephone orders

Orders can be placed by telephone through Customer Services.

To cancel or modify an order, the customer must contact Customer Services. A cancellation is only possible during the opening hours of Customer Services and is valid only after confirmation from Customer Service.

Alloboissons reserves the right to cancel orders. The customer is, in this case, informed by email before the delivery of the goods.

For quality control purposes, telephone conversations between customers and Alloboissons employees may be recorded.

6.1        Price & schedule

We deliver throughout Switzerland with our own team of drivers or a specialised courier, ensuring a personalised delivery service. Delivery is made according to the schedule agreed at the time of order (see order confirmation).

Shipping costs:

  • Flat rate per delivery: CHF 15.00 (excl. VAT)
  • Additional cost for delivery outside agreed schedule: CHF 35.00 (excl. VAT)

The customer can indicate delivery time preferences. However, this schedule is a preference only and cannot be guaranteed due to order volumes.

 

6.2        Delivery within limits of available stock

Despite careful inventory management, it can happen that some items sell faster than expected. Therefore, we cannot offer a guarantee of delivery. Delivery is only possible within the limits of available stock.

Products marked "(D) Delivery Delay" require an additional period of approximately 15 days for delivery. As they are especially ordered, these products cannot be returned.

7.1        Return of goods

The return of especially ordered goods is excluded. In case of written agreement and exceptionally, other goods will be taken back at 80% of their invoiced value but only in perfect condition, in the original packaging, with an expiry date or a vintage permitting resale. Please contact Customer Service or the Sales Department.

Goods that can be ordered individually (by the bottle) cannot be returned.

7.2        Return of corked wine

If the wine you ordered has a defect within 12 months of the delivery date, please contact Member Service (club@divo.ch) within 10 days of opening the bottle.

The bottle must be given to us ¾ full, with the original cork for a possible reception by our drivers.

After verifying, a credit note will be issued.

7.3         Return of empty packaging

Empty packaging is taken back at the deposit price in the same quantities as those delivered and must be returned having been sorted. Any exceptional return of empty packaging (without purchase of full at equal volume) must be expressed in advance.

Returnable bottles can be returned in the crates only.

7.4        Credit notes

You can either deduct the amount of the credit note on the payment of your next invoice or ask us for a refund by sending your bank details to our Accounting Department: mailbox.comptabilite@allolboissons.ch

When returning empties, a ticket mentioning the amount owed to you is sent to you. You can directly deduct this amount from the total amount payable.

8.1        Data collection and usage

When a visitor accesses the internet portal, various data is stored (e.g. IP address, date and time of access, name of the file accessed, etc.).

Personal data is not subject to any use. Anonymous data analysis is only carried out for statistical purposes, e.g. to establish the daily number of visits to the website.

The data is stored confidentially. It is not transmitted to third parties outside the Alloboissons Group, unless this is required by law, namely by the criminal judicial authorities.

Any data processing by us or by third-party service providers, e.g. via cookies or social plugins (see next point) remains strictly reserved.

The security of stored personal data (e.g. in connection with the newsletter subscription) is guaranteed.

8.2        Account creation

The creation of an account is exclusively reserved for persons exercising their civil rights. To place an order, the customer must identify themselves with an email address and password in the online shop.

If this is a first order and the customer does not yet have an online account, the customer will be asked to create a user account and enter the data required for registration. This data must be complete and true. The customer is obliged to update data personally. The account creation request will be inspected and validated within 48 hours. Registration is free. It does not amount to a right of access to the online shop.

The customer undertakes to protect their account and not transmit their password to third parties.

8.3        Newsletters and mailings

An email with information on news or special promotions will be sent several times a year to the email address given during registration. The subscription to the newsletter can be cancelled at any time. Details can be found at the foot of the newsletter.

A letter will be sent several times a year to the postal address. The customer may at any time cancel this through simple written notification to Customer Service.

9.1        Product visuals

Photos of the bottles do not necessarily indicate the vintage being sold. Please refer to the currently available vintage indicated in the product description as the packaging and capping of bottles may vary from one vintage to another, or even within the same vintage.

9.2        Replacement wine

Unless expressly requested, we deliver the next vintage of an unavailable wine without prior notification, provided that it is comparable in terms of grape varieties, price and quality. In the case of premium wines for ageing, we only provide the next vintage if you have authorised us to do so.

9.3        Minimum Order

There is no minimum order.

9.4        Copyright

The design of the home page, the graphics and visuals used, the collection of contributions as well as certain contributions are protected by copyright. Reproduction and use are only permitted with the express permission of Alloboissons SA. All rights reserved.

9.5        Contest participation conditions

All persons residing in Switzerland or Liechtenstein and aged 18 or over are eligible to participate. Winners are notified in writing. Only their first and last name may be made public. Personal data is kept confidential and is not passed on to third parties. Contests do not give rise to any correspondence. Cash payment, exchange and accumulation of prizes are excluded. The judicial route is excluded. Participation in contests is free of charge. The duration is indicated in the terms and conditions of each contest. Unless otherwise stated in the terms and conditions of the contest, prizes are sent to the winners.

Our terms and conditions are based on Swiss law. The place of jurisdiction is Fribourg.
